1. Acceptance of Terms
By accessing or using HireCurve ("the Service"), available at hirecurve.net and operated by HireCurve ("we", "us", or "our"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you may not use the Service. These terms apply to all visitors, users, and anyone who accesses or uses the Service.
2. Description of Service
HireCurve is an AI-powered platform that helps users tailor resumes and cover letters to specific job descriptions. The Service includes resume generation, ATS (Applicant Tracking System) keyword optimization, cover letter creation, interview preparation tools, and resume templates. Features, pricing, and availability may change over time at our discretion.
3. Eligibility
You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you are at least 16 years old and have the legal capacity to enter into these terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.
4. Accounts and Registration
You must create an account to use most features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate, current, and complete information during registration and keep it up to date. You agree to notify us immediately at support@hirecurve.net of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these terms or that we reasonably believe are being used fraudulently.
5. Free and Paid Plans
The Service offers a free tier with limited usage (up to 3 tailored applications per month) and paid subscription plans with expanded features. Paid plans are billed on a monthly or annual basis through our payment processor, Stripe.
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period, and you will continue to have access to paid features until then.
Refunds are not provided for partial billing periods unless required by applicable law. We reserve the right to change pricing with 30 days' advance notice. Continued use of the Service after a pricing change constitutes acceptance of the new pricing.
6. Your Content
You retain full ownership of all content you provide to the Service, including resumes, work history, education, skills, and personal information. By using the Service, you grant us a limited, non-exclusive license to process your content solely for the purpose of delivering the Service to you.
We do not sell your content to third parties. We do not use your personal content to train AI models. Your content is sent to our AI provider (Anthropic) solely to generate tailored outputs for you; refer to Anthropic's Privacy Policy for details on their data handling.
7. AI-Generated Content
The Service uses artificial intelligence to generate tailored resumes, cover letters, and related content. While we strive for accuracy and quality, AI-generated content may contain errors, inaccuracies, or phrasing that does not accurately reflect your experience or qualifications.
You are solely responsible for reviewing, editing, and verifying all generated content before using it in any job application or professional context. We are not liable for the outcome of any job application that uses content generated by the Service, nor for any consequences arising from inaccurate AI-generated content.
8. Acceptable Use
You agree not to use the Service to: generate fraudulent, misleading, or deceptive content; misrepresent your qualifications or experience; violate any applicable law or regulation; attempt to reverse-engineer, decompile, or scrape the Service or its underlying technology; interfere with the operation of the Service or other users' access to it; use automated scripts or bots to access the Service; resell, sublicense, or redistribute the Service or its outputs without our written permission; or upload malicious code or content.
9. Intellectual Property
The Service, including its design, source code, branding, logos, documentation, and all related materials, is owned by HireCurve and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without prior written permission. The AI-generated outputs you create using the Service are yours to use freely for personal and professional purposes.
10. Third-Party Services
The Service integrates with third-party providers including Clerk (authentication), Stripe (payments), Anthropic (AI generation), Neon (database), and Vercel (hosting). Your use of the Service may be subject to the terms and privacy policies of these providers. We are not responsible for the practices or policies of third-party services.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that AI-generated content will be accurate, complete, or suitable for any particular purpose.
12. Limitation of Liability
To the fullest extent permitted by law, HireCurve shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or opportunities, arising from your use of or inability to use the Service. Our total aggregate liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.
13. Indemnification
You agree to indemnify, defend, and hold harmless HireCurve, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these terms, or your violation of any rights of a third party.
14. Termination
We may suspend or terminate your access to the Service at any time for violation of these terms or for any other reason at our reasonable discretion, with or without notice. Upon termination, your right to use the Service ceases immediately. You may request export of your data before or within 30 days after termination by contacting us at support@hirecurve.net. Sections 6 through 13 of these terms survive termination.
15. Dispute Resolution
Any dispute arising from these terms or the Service shall first be addressed through good-faith negotiation. If the dispute cannot be resolved informally within 30 days, it shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the United States, and the language of the proceedings shall be English.
16. Changes to These Terms
We may update these Terms of Service from time to time. If we make material changes, we will notify you by email or by posting a prominent notice on the Service at least 15 days before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated terms. The "Last updated" date at the top indicates when this version was last revised.
17. Governing Law
These terms are governed by and construed in accordance with the laws of the United States. Any legal action not subject to arbitration shall be brought in the courts of competent jurisdiction within the United States.
18. Severability
If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
